GENERAL TERMS OF USE FOR THE AVOCATEL.RO PLATFORM

1. Preliminary Information

This document defines the legal terms for using the https://avocatel.ro platform ("Website") as a visitor, user, or client ("User"). Accessing the website, creating an account, or purchasing credits constitutes full and unconditional acceptance of these Terms and Conditions. If you do not agree with this document, please stop using the website immediately.

• User – any person who accesses avocatel.ro, uses the platform's services, and accepts the Terms and Conditions.
• Account – a digital interface created with email identification, accessible via a magic link.
• Credits – virtual units purchased by the user to ask questions.
• Platform – the avocatel.ro website and all services it provides.

4. Description of Services

avocatel.ro is a digital platform developed by Bács M-Cs. Balázs ÎI to provide a tool based on artificial intelligence (LLM) for answering general legal questions using official documents (e.g., Tax Code, Labor Code, Civil Code). Users can purchase credits in RON via Stripe and use them to ask questions to the AI. The platform also includes additional features such as a specialized questionnaire to help users obtain more accurate information for specific legal situations, an invitation system that allows users to invite others to use the platform, and location-based recommendations for legal professionals in the user's area.

5. Account Creation and Authentication

To access avocatel.ro, users must log in with their email address. Access is granted via a magic link sent to the provided email address. The platform does not request names, phone numbers, or other personal data. Users are responsible for the security of their email address and all activities conducted through their account.

6. Orders, Payments, and Credits

Credits can be purchased in RON via Stripe. Payment is made using a bank card and redirected to the Stripe page. There are no recurring subscriptions. Four fixed-price packages are available. After payment approval, credits are immediately available in the account. Purchases are processed through the Stripe payment processor. Transactions are secure and incur no additional fees. Stripe's terms and conditions are displayed before finalizing the payment or accessible at https://stripe.com/en-ro/legal/consumer, and users are responsible for reading them. Users can check their credit balance in their account. Credits are non-refundable and non-transferable to other users.

7. Platform Usage

Users can ask questions to the integrated LLM, which provides answers based on official legal documents. All messages are stored locally and encrypted to protect sensitive data potentially provided by users. Messages are only accessible on the device used at the time of access. If users log in from another device, messages will not be available. Users can save conversations in PDF format.

7.1. Questionnaire

The platform allows users to fill out a questionnaire to obtain more accurate legal information. The questionnaire is designed to better understand the user's specific legal situation and provide recommendations tailored to specific circumstances. Responses to the questionnaire are processed solely to generate relevant recommendations and are not stored or used for other purposes.

7.2. Invitation System

Users can send invitations to others to use the avocatel.ro platform. Invitations are sent via email to the address provided by the user. By using the invitation feature, the user confirms they are authorized to contact the invited persons. Bács M-Cs. Balázs ÎI does not collect or store the data of invited persons without their explicit consent. Each invited person has the freedom to accept or ignore the invitation.

7.3. Geolocation Services

The platform uses geolocation services to provide location-based recommendations for legal professionals in your area. The platform requests access to your device's location through your browser's geolocation API. This requires your explicit permission through your browser's location permission prompt. The coordinates obtained are used to determine your city through OpenStreetMap's Nominatim service and provide relevant legal professional suggestions. Location data is processed in real-time and is not stored on our servers. You can deny location access at any time through your browser settings, though this may limit the accuracy of location-based recommendations.

8. Right of Withdrawal and Refunds

Due to the digital nature of the services offered, credits are non-refundable as they are considered immediately delivered digital content. By purchasing credits, users explicitly agree to waive their right of withdrawal under Article 16(m) of OUG 34/2014 on consumer rights. However, if users can prove they received completely false information or technical errors occurred (e.g., payments did not generate credits), refunds may be approved at the discretion of Bács M-Cs. Balázs ÎI.

9. Limitation of Liability

avocatel.ro DOES NOT provide personalized legal or financial advice. Responses generated by the LLM are for informational purposes only and do not constitute legal, financial, or professional advice. Users are solely responsible for using the information provided by the platform. avocatel.ro does not guarantee the accuracy or timeliness of responses and cannot be held liable for damages, losses, or consequences resulting from the use of its services. Users are advised to consult a lawyer or licensed expert for specific situations or legal/financial decisions. The service is intended solely for general information purposes. AI responses are generated automatically without human intervention, and responsibility for their use lies solely with the user. Bács M-Cs. Balázs ÎI is not liable for decisions made based on information provided by the application.

10. Privacy and Data Protection (GDPR)

avocatel.ro complies with the General Data Protection Regulation (GDPR - EU 2016/679). The only personal data stored is the email address. Messages are stored only on the device used and are encrypted. Users are responsible for the content of questions sent to the AI. Do not provide sensitive data in the chat. • Right to access, rectify, and delete data.
• Right to data portability and restriction of processing.
• Right to file a complaint with ANSPDCP (National Supervisory Authority for Personal Data Processing).

11. Third-Party Providers and Technical Infrastructure

• OpenAI (USA) provides the artificial intelligence infrastructure via the Assistant API. Questions asked by users are transmitted and processed by OpenAI, and Bács M-Cs. Balázs ÎI has no control over how this organization handles such data. Users are responsible for the content of their questions, including sensitive personal data.
• Supabase is used to manage user account authentication and storage. Data is stored on European servers and protected by specific security measures (encryption, access control).
• Stripe handles all payments made on the platform. All banking information and transactions are processed directly by Stripe, and Bács M-Cs. Balázs ÎI does not have access to card details. Before finalizing payment, users can access Stripe's terms and conditions directly on the payment screen and are responsible for reading them before purchase. 12. Intellectual Property

All materials, text, structure, graphical interface, and content on the Website are protected by copyright and may not be copied, distributed, or modified without written consent from Bács M-Cs. Balázs ÎI.

13. Applicable Law and Disputes

These Terms and Conditions are governed by Romanian law. All disputes will be resolved by the competent courts in Bucharest. Users have the right to contact the National Consumer Protection Authority (ANPC) or use the SOL platform for online dispute resolution. Disputes will be resolved amicably whenever possible. If not, disputes will be resolved by the competent courts in accordance with Romanian law.

14. Amendments to the Terms and Conditions

Bács M-Cs. Balázs ÎI may amend these Terms and Conditions at any time without prior notice. The updated version will be available on the website, and continued use of the services after such updates constitutes acceptance of the new provisions.
